QUETTA: Th Balochistan High Court (BHC) has remarked that “we see spectacle of institution failure” in the case of the child, Abdul Musawir, where multiple agencies including the constituted JIT demonstrated shocking ineptitude, filing what can only be described as pro forma reports devoid of any genuine investigative efforts.
The division bench comprising Mr. Justice Iqbal Ahmed Kasi and Mr. Justice Muhammad Ayub Khan Tareen heard the constitutional petition filed by one Haji Raz Muhammad, father of Abdul Musawir for recovery of his child, aged about 10/11, abducted by unknown in November last year, on Tuesday.
According to the judgment, the court assembles today to formally dispose of the case, but does it with heavy heart and profound sorrow at the catastrophic failure of our law enforcement machinery.
“What should have been a routine investigation into a child’s abduction became instead a damning indictment of system incompetence.”
The court recorded the deepest anguish regarding the unconscionable delay that an innocent child remained missing for more than seven months without any substantive progress in the investigation, until his lifeless body was discovered through sheer happenstance rather than police work.
The judgment said that, for satisfaction over the court, when again a specific query was put to the Chairman / Convener JIT and DIG Police that the dead body was recovered from where and how, surprisingly, they stated that the dead body of child was recovered from Splingi, Quetta, which admittedly, is only 50 kilometers far-away from the place of abduction of the child, whereas, they also admitted that from the time of kidnapping of abductee till his death, he was available within the radius of 50 kilometers from Quetta city.
Thus, we with grave concern have to state they the JIT and the other law enforcement agencies have failed to fulfil their obligatory duty, provided under the law, and we are afraid that such an amazing statement on the part of the high-ups of the police department could betray the public trust, the court observed.
As the case concluded, the court offered its deepest condolences to Musawir’s family, however, directed all the concerned law enforcement agencies including JIT to continue their efforts towards the arrest of the culprits and submit challan before the competent court of law.
Later, the court disposed of the constitutional petition.
Earlier, the concerned police high ups submitted a detailed report along with certain annexures, which were taken on record.
